1. Acceptance of Terms

By accessing and using Local Rank Tracker ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Local Rank Tracker is a Google Maps rank tracking platform that allows users to monitor and analyze local search rankings for businesses across multiple keywords and geographic locations. The Service includes access to our web application, API, rank tracking data, and related features.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years of age
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Payments

Local Rank Tracker offers various subscription plans with different credit limits and features. By subscribing to a paid plan:

  • You agree to pay all fees associated with your chosen subscription plan
  • Subscriptions automatically renew unless cancelled before the renewal date
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice to existing subscribers
  • Credits are allocated per billing period and do not roll over unless otherwise specified

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service except through our official API
  • Resell, redistribute, or sublicense access to the Service without permission
  • Scrape, collect, or harvest data from the Service for competitive purposes
  • Submit false, misleading, or fraudulent information

6. Data Accuracy and Limitations

While we strive to provide accurate rank tracking data:

  • Rankings are based on third-party data sources and may not reflect real-time results
  • Google Maps rankings can vary based on numerous factors including location, device, and user personalization
  • We do not guarantee 100% accuracy and are not liable for decisions made based on our data
  • The Service is provided "as is" without warranties of any kind

7. Intellectual Property Rights

Local Rank Tracker and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our express written permission.

You retain all rights to the business data, keywords, and other content you submit to the Service. By using the Service, you grant us a license to use this data solely to provide the Service to you.

8. Third-Party Services

The Service integrates with third-party services including Google Maps API, payment processors, and data providers. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, content, or policies of these third parties.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may:

  • Perform scheduled maintenance with advance notice when possible
  • Modify, suspend, or discontinue any part of the Service at any time
  • Impose usage limits or restrictions

We are not liable for any downtime, data loss, or inability to access the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Local Rank Tracker and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Local Rank Tracker from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

12. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment fails
  • We are required to do so by law
  • We discontinue the Service

Upon termination, your right to access the Service will immediately cease. We may retain certain data as required by law or for legitimate business purposes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Local Rank Tracker operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notice constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and terminate your account.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Local Rank Tracker regarding the Service and supersede all prior agreements and understandings.
